Terms & Conditions 

1. Scope

These Terms & Conditions govern all sales and bookings made through JustStargaze.com, including:

• Event tickets (such as the 2026 Solar Eclipse Cruises)

• Merchandise (such as solar eclipse glasses and astronomy-related products)

By placing an order, you confirm that you are at least 18 years old and capable of entering into a legally binding contract.

3. Prices and Payments

All prices are displayed in euros (€) and include applicable taxes (IVA) unless stated otherwise.
Payment is required in full at the time of booking or purchase through our secure online payment system.

Accepted payment methods include credit/debit cards and other options as displayed at checkout.
We reserve the right to modify prices at any time prior to purchase confirmation.

4. Event Bookings

Our events (including the 2026 Solar Eclipse Cruises) are limited, fixed-date experiences.
By completing your booking, you agree to the following specific terms:

• Bookings are confirmed upon payment.

• Due to the limited capacity and one-time nature of this astronomical event, all bookings are non-refundable from 30 days prior to the event date.

• In accordance with EU Directive 2011/83/EU, Article 16(l), “the right of withdrawal shall not apply to services related to leisure activities if the contract provides for a specific date or period of performance.”

• This means that tickets for the 2026 Solar Eclipse Cruises and similar fixed-date events are exempt from cancellation and refund rights.

5. Weather and Unforeseen Conditions

The Solar Eclipse Cruise on 12 August 2026 is a fixed-date astronomical event that cannot be postponed or repeated. By completing a booking, the client acknowledges and accepts the special conditions outlined below.

1. Weather and Visibility

​

Astronomical events depend on natural conditions. Clear skies, visibility of the eclipse, or optimal viewing conditions cannot be guaranteed.

Cloud cover, reduced visibility, or partial obstruction of the phenomenon do not constitute grounds for cancellation, compensation, or refund.

2. Cancellation by Organizer

​

If the event is cancelled by Astronomy Tours S.COOP due to:

• safety concerns,

• maritime authority restrictions,

• insufficient participants,

• technical issues,

• force majeure (including but not limited to severe weather, natural disasters, governmental decisions),

no monetary refund will be issued.

Instead:

An administrative and operational fee of 40% of the total booking price will be retained to cover vessel reservations, permits, staffing, transaction costs, and marketing expenses already incurred.

The remaining 60% of the booking value will be issued as credit.

3. Use of Credit

​

The issued credit:

• May be used only for regular scheduled Astronomy Tours S.COOP events (non-private experiences).

• Cannot be used for private bookings, add-ons, accommodation, merchandise, upgrades, or special packages.

• Cannot be split into multiple tickets or exchanged for more than one place in another event.

• Is limited to the value of the remaining credit.

• If the price of the selected replacement event is lower than the available credit, no monetary difference will be paid.

If the price of the selected event exceeds the credit amount, the client may pay the difference.

The maximum compensation available is limited to the price of the most expensive regular scheduled event offered by Astronomy Tours S.COOP at the time of rebooking.

6. Merchandise Sales (Eclipse Glasses & Other Products)

​

For physical products purchased through our store:

• Orders are processed within 3 business days.

• Shipping costs and delivery times are detailed in our [Shipping Policy].

• You have the right to return unused, unopened merchandise within 14 days of receipt, as per EU consumer law, except for personalized or hygiene-sensitive items

Returns & Refunds for Solar Eclipse Glasses
For safety and hygiene reasons, solar eclipse glasses and other optical safety products cannot be returned or refunded once shipped, even if unopened, as we cannot guarantee their optical integrity after leaving controlled storage.

This exception is permitted under EU Directive 2011/83/EU, Article 16(e) on health and hygiene products.

If your order arrives damaged or incorrect, please contact us within 7 days of receipt at contact@juststargaze.com, and we will arrange a replacement or refund where applicable.

7. Intellectual Property

All website content — including text, images, logos, and graphics — is the property of Astronomy Tours S.COOP and protected under applicable intellectual property laws.
Use or reproduction without written consent is prohibited.

8. Liability Disclaimer

Participation in our outdoor or maritime events (such as the Solar Eclipse Cruise) is voluntary and at your own risk. Astronomy Tours S.COOP ensures all reasonable safety measures are followed but shall not be liable for:

• Changes due to weather or natural phenomena

• Equipment malfunction beyond our control

• Personal injury, loss, or damage caused by participant negligence or failure to follow safety instructions

We strongly recommend adequate personal travel and event insurance.

9. Privacy

Your data is processed in accordance with our [Privacy Policy], compliant with the General Data Protection Regulation (EU 2016/679).

10. Governing Law

These Terms & Conditions are governed by the laws of Spain.
Any dispute shall be submitted to the jurisdiction of the Courts of Cartagena (Murcia, Spain), unless otherwise required by mandatory consumer protection laws.
